10mins Platform Terms (Coaching & Tutoring)
1. Parties and what 10mins does
These terms are between Ironbay Innovations Pvt Ltd (“10mins”), 14/102 Malhar Sahara Estate, Gorakhpur, Uttar Pradesh, India, and the business that registers a coaching or tutoring app on the platform (“you”, the “Academy”). By opening your admin panel you accept them; your acceptance is recorded with the version, date and time.
10mins provides software only: a student app, a coach app, a website and an admin panel. 10mins is not a school, coaching centre, examining body, employer or training provider, does not hold your fees, and is not a party to any enrolment, session, class, certificate or teacher relationship.
2. You are the education provider
- You alone offer the classes and sessions to the public. You are responsible for their content, accuracy, quality, price, refunds and compliance with law, including where it applies the Ministry of Education's Guidelines for Regulation of Coaching Centres 2024 as adopted by your State, State coaching-centre and shops-and-establishments rules, and consumer law.
- You must hold any registration, licence or permission your State requires for the service you run, show it to students, and keep your Legal & Policies details accurate. You must not run the service where you do not hold what is required.
- You must not make false or misleading claims about results, ranks, selections, teachers' qualifications or fees, and must follow the CCPA's guidelines on misleading advertisements in the coaching sector.
- You must charge, collect and account for GST and other taxes that apply to your services.
- You decide the minimum age you accept and must meet any minimum-age or schooling condition that applies to you.
3. Students, especially children
- You are the Data Fiduciary for your students' personal data. Where a student is under 18 you must obtain and keep verifiable consent from a parent or guardian. The app collects the guardian's name and phone and records the acceptance; contacting the guardian to verify it, and acting on a withdrawal, is your job.
- You must not track, profile or advertise to children, and you must not use the software for that.
- You must act on safety reports and on any concern involving a child promptly, suspend anyone you reasonably believe is a danger, and report serious matters to the authorities. The Report a problem function alerts you; responding is your duty.
4. Teachers and staff
- You decide whether teachers are employees or independent contractors and you take the legal consequences, including labour, tax and social-security duties.
- You must check each teacher's identity, qualifications and, where appropriate, background before you let them teach children. The verification screen records the documents they upload; it does not verify them for you.
- You must require teachers to follow the Student Safety & Conduct Policy, and you are responsible for the acts of those you appoint, including staff logins you create.
- Staff roles limit what a login can do; you remain responsible for what your staff do.
5. Money
- 10mins never holds your fees. Students pay you or the payment provider you connect. A purchase paid by hand opens only after you approve it: you must check each payment against your bank or UPI record before approving it, and you remain responsible for access you grant.
- Refunds are your decision and are paid by you. The app records them; it does not move money. Teacher pay is recorded by the app and paid by you.
- If you use the 10mins payment gateway, a payment partner may route a share of each payment to 10mins as the fee agreed, with the rest going to your bank account. If you connect your own Stripe account, a commission on those sales is billed to you as shown in the admin panel.
- 10mins bills its platform fee as shown in the admin panel: a monthly subscription and a percentage of your recorded sales. A sale is recorded from the day you approve it, and a refund you record reduces the amount billed for any billing cycle not yet invoiced. Non-payment may suspend access for new purchases; existing students keep access.
6. Certificates, tests and results
Certificates and results are issued by you in your name. You are responsible for what they say and for any claim a student makes about them. 10mins does not examine, mark or certify anyone.
7. AI features
The AI study helper, lesson-description drafts, notes, test-checking and knowledge-base features send text, images and documents to a third-party AI provider and return generated output. Output can be wrong. You are responsible for what you publish and what you tell students to rely on, and for the knowledge-base material you upload, which you must have the right to use. You can limit or switch off the student AI helper in your settings.
8. Third-party services
The app uses YouTube, Zoom, Google Meet, payment providers and messaging providers. Their own terms apply and you must follow them, including their rules on recording and on children.
9. Policies for your students and teachers
10mins supplies templates for the student terms, refund policy, privacy policy, safety policy, grievance page and coach agreement. 10mins' clauses in them cannot be edited; you may add terms after them. Where an addition conflicts with 10mins' clauses, 10mins' clauses prevail. The documents are drafted as support, are not legal advice, and you should have them reviewed by your own lawyer.
10. Responsibility and indemnity
- You are responsible for claims by students, parents, teachers, regulators and third parties arising from the operation of your academy. You will indemnify 10mins and its directors and staff against claims, fines and costs arising from your academy, your teachers, your content, your breach of law or these terms, or what you add to the policies.
- 10mins provides the software “as is”, without warranty that it will be uninterrupted or fit for a purpose beyond its documentation. 10mins' total liability to you is limited to the fees you paid it in the 3 months before the claim, except where the law does not allow it. 10mins is not liable for indirect or consequential loss, loss of profit, or loss from a registration being refused or withdrawn.
11. Suspension and ending
10mins may suspend an app that appears unlawful or unsafe for children, or on a court or authority's direction. You may leave at any time; you can export your data before you go. Sections that by their nature survive, do.
12. Law
Indian law governs. The courts at Gorakhpur, Uttar Pradesh have exclusive jurisdiction, subject to any right that cannot be excluded. Notices go to contact@10mins.co.
